Terms of Service
The legally binding contract governing your access, purchases, vendor store creation, and bookings on Living Culture Health.
1. Acceptance of Terms
By accessing or using the Living Culture Health marketplace, mobile interfaces, or booking platforms, you agree to be bound by these Terms of Service, our Privacy Policy, Community Guidelines, and all incorporated policies. If you do not agree to these terms, you must not access or use our services.
2. Account Registration & User Responsibilities
Users must provide truthful, current, and complete information when registering. You are responsible for safeguarding your login credentials and for all activities that occur under your account.
Vendors and service providers must be legally incorporated businesses, accredited cultural custodians, or verified artisanal collectives with appropriate CIPC or national commercial registration.
3. Marketplace Rules & Transactions
• Living Culture Health provides a multivendor e-commerce platform connecting independent African makers and experiential hosts with global consumers.
• Prices are displayed in South African Rand (ZAR) or local currency equivalents, inclusive of applicable Value Added Tax (VAT) where required.
• Orders become legally binding upon successful payment confirmation. Sellers are contractually obligated to dispatch items within their stated fulfillment window (typically 1-3 business days).
4. Experiential Bookings & Cultural Excursions
• Bookings made through the Services Directory (cultural villages, UNESCO tours, foraging retreats) constitute an agreement between the traveler and the accredited host.
• Travelers must adhere to sacred cultural protocols, community dress codes, and local environmental protection regulations as specified by the host.
5. AI-Assisted Features & Limitations
Living Culture Health provides AI-assisted recommendations via the Antigravity Assistant. While we strive for accuracy, traditional medicinal and botanical guidance provided on the platform is for educational and cultural discovery purposes only and does not constitute formal medical advice. Consult qualified healthcare professionals regarding medical conditions.
6. Prohibited Conduct
You agree not to:
• Sell counterfeit goods, stolen cultural artifacts, endangered flora/fauna (CITES violations), or prohibited substances.
• Interfere with platform infrastructure, scrape listings using unauthorized automated bots, or reverse-engineer the codebase.
• Harass sellers, leave fraudulent or malicious reviews, or circumvent platform payment gateways.
7. Disclaimers & Limitation of Liability
The platform is provided 'as is' and 'as available'. To the maximum extent permitted under South African Consumer Protection Act (CPA) No. 68 of 2008 and applicable laws, Living Culture Health disclaims all warranties, express or implied.
In no event shall Living Culture Health, its directors, or affiliates be liable for indirect, incidental, punitive, or consequential damages arising from the use of goods purchased from third-party sellers.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with this agreement shall first be submitted to good-faith mediation under the rules of the Arbitration Foundation of Southern Africa (AFSA).
